Access to Medical Records

Patient’s Right to Medical Records

The patient has the right to access medical records concerning their state of health and the healthcare services provided to them.
The data contained in the medical records is protected under the Act on Patient Rights and the Patient Rights Ombudsman as well as other applicable legal regulations.
ŁUBA DENTAL CLINIC provides access to medical records to the patient, their legal representative, or a person authorized by the patient based on written authorization obtained during the patient’s first contact with ŁUBA DENTAL CLINIC.
The submitted authorization remains valid until it is revoked by the patient or – in the case of a legal representative’s statement – until the child reaches the age of majority (18 years).

Rules for Charging Fees for Access to Medical Records

No fee is charged for providing access to medical records in the following cases:

  • To the patient or their legal representative for the first time within the requested scope,
  • In connection with proceedings before the Provincial Commission for Medical Incident Investigation.

Free access to the records within a given scope is granted only once. The use of the right to a free copy by one authorized person excludes the possibility of another authorized person obtaining the same records free of charge.
Maximum fees for providing access to medical records are as follows:

  • Extract or transcript – 0.002 of the average wage in the previous quarter according to data from the Central Statistical Office (GUS) per page,
  • Copy or printout – 0.00007 of the average wage per page,
  • Records on an electronic medium – no more than 0.0004 of the average wage.

Legal basis: Article 28 of the Act of 6 November 2008 on Patient Rights and the Patient Rights Ombudsman (Journal of Laws 2017, item 1318, consolidated text).
The owner of ŁUBA DENTAL CLINIC may, at their discretion, waive the fee for preparing a copy of the medical records.
